  <title>STATEMENT OF THE UP COLLEGE OF LAW FACULTY</title>

  <description>Last Friday, February 24, 2006, Gloria Macapagal-Arroyo issued  Presidential Proclamation 1017, declaring a state of national emergency. Immediately after, she issued General Order No. 5, directing the chiefs of the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP) to “immediately carry out necessary and appropriate actions and measures to suppress and prevent acts of terrorism and lawless violence.” &lt;br /&gt;&lt;br /&gt;Since then, these two issuances have been used to justify the imposition of severe limitations on — and in certain instances the outright denial of — civil liberties guaranteed and protected under the Bill of Rights, including the freedoms of speech, expression, of the press, and public assembly. Ostensibly on the strength of Proclamation 1017 and General Order 5, a general ban on rallies has been imposed, the PNP has raided one newspaper and threatens to take over other media outfits which “fail to conform to government standards,” and numerous persons, including several members of Congress, have been arrested without warrant. &lt;br /&gt;&lt;br /&gt;We, the faculty of the University of the Philippines College of Law, speaking with one voice, condemn in the strongest possible terms this brazen assault on essential freedoms. We firmly and unequivocally take the position that Proclamation 1017 and General Order 5, and the manner in which they are being applied by the Executive, constitute an unconstitutional infringement on civil liberties. &lt;br /&gt;We refuse to accept the half-hearted excuse, put forth by some officials in the Arroyo administration, that the two issuances were “not intended” to violate the Bill of Rights. &lt;br /&gt;&lt;br /&gt;The simple and undeniable fact is that Proclamation 1017 and General Order 5 have been utilized by the PNP and other executive organs to mount a vigorous and unrelenting campaign against perceived critics of the administration, in full and flagrant disregard of the protections enshrined in the Bill of Rights as well as the legal rules of procedure. Equally undeniable is that the President has sanctioned, or at the very least tacitly approved, these actions undertaken by her subordinates, all of whom are fully within her control. &lt;br /&gt;&lt;br /&gt;The indisputable truth is that the violations of the Bill of Rights done pursuant to Proclamation 1017 and General Order 5 are acts of the President. &lt;br /&gt;&lt;br /&gt;It must be emphasized that nothing in the Constitution can authorize the suspension of the Bill of Rights. Even under a declared state of martial law, which the Arroyo administration repeatedly insists this is not, the Bill of Rights remains fully operative. Thus, the suppression of free speech, the muzzling of the free press, and the prohibition on public assembly sanctioned by the two issuances cannot be construed as anything other than clearly and unequivocally unconstitutional. &lt;br /&gt;Our civil liberties, particularly the freedom of speech and public assembly are indispensable to our democracy. We cannot allow them to be arbitrarily suppressed. We therefore call for the immediate and unconditional rescission of Proclamation 1017 and General Order 5.</description>

  <title>Admittedly madrama and hastily written, but freedom of expression gives me the prerogative)</title>

  <description>After going to Makati and having lunch with Glads and Ches, I was able to watch the news coverage on the President&apos;s Proclamation.&lt;br /&gt;Earlier, en route to Makati, we had passed by Edsa Shrine and actually saw the rally. It seemed like a small crowd--far smaller than previous Edsa gatherings. However, as we all now, that things had escalated drastically and eventually ended in violence. &lt;br /&gt;I watched, in my small TV, as members of the police bludgeon realists. &lt;br /&gt;&lt;br /&gt;My God.&lt;br /&gt;&lt;br /&gt;My reaction reminded me of Francois Mauriac&apos;s words when faced by Nazi brutality, &quot;It is not always the events we have been directly involved in that affect us the most.&quot; &lt;br /&gt;&lt;br /&gt;So I sat there, shaking--literally shaking as a rallyist (I&apos;m assuming he was a rallyist), is yanked by the shirt by a police officer, thrown onto the pavement and is hit by a policeman&apos;s truncheon, not once, not twice but three times. The man was hit, despite the fact that he was writhing in the floor in pain, despite the fact that he had lifted his arms to shield himself, despite the fact that he was defenseless and weaponless despite the fact that he posed no threat to the policemen. The policeman left the man prone on the sidewalk. The man is motionless. Onlookers flock to him and try to see if he is alright. The man is conscious, however, he clutches his head, he is obviously in pain.   &lt;br /&gt;&lt;br /&gt;I bit my lip, I cry a little. And I scream, in the stillness of my dorm room, &quot;Shit, putang ina! You can&apos;t do that!&quot;&lt;br /&gt;&lt;br /&gt;Granted, it is possible that the first blow came from militant rallyist. It is possible that peaceful dispersal methods were employed by the police, in accordance with BP 880. It is possible that maximum tolerance was initially observed by the police. However, the duty to observe maximum restrain does not cease after the first blow has been struck. &lt;br /&gt;&lt;br /&gt;The fact that the first blow could have been made by the rallyist does not give the state unbridled license to restrain violent rallyist in any manner they choose to. Bastas Pambansa Blg. 880 imposes a standard of restraint upon the state and its agents (in this instance, the police). Batas Pambansa Blg. 880 requires that the military, police and other peace keeping authorities observe MAXIMUM TOLERANCE in dispersal of a public assembly. As such, once a rallyist poses no danger to a police man, the same policeman has ABSOLUTELY NO RIGHT to keep on hitting that person. Regardless of the fact that the wrong was initially committed by the rallyist, an official/agent/employee of the state has no right to pummel the person back, except if such official/agent/employee is in danger of sustaining personal injury from the rallyist.  &lt;br /&gt;&lt;br /&gt;Section 3 (c) of Batas Pambansa Blg. 880 defines &quot;Maximum tolerance&quot; as the highest degree of restraint that the military, police and other peace keeping authorities shall observe during a public assembly or in the dispersal of the same.&lt;br /&gt;&lt;br /&gt;In my book, hitting a defenseless man does not constitute the highest degree of restraint during the dispersal of a public assembly. Police (ideally) are specially trained in measures to peaceably disperse crowds such as this. This added training adds credence to the claim that the dispersal today at EDSA-SANTOLAN was not in accordance to the duty the BP880 imposes upon peace officers.  &lt;br /&gt;For those of you thinking, but this is merely a manifestation of the president&apos;s calibrated pre-emptive response and as such valid, you are wrong. A president with no legislative authority has no right to amend the maximum restrain rule in BP880, The CPR does not exist in our statute books or appear in any decision of the Supreme Court. This is of paramount importance because in a civil law country such as ours, laws must be written in the books and passed by a body with proper legislative authority to have legal effect. As such, calibrated pre-emptive response cannot prosper in this jurisdiction. &lt;br /&gt;&lt;br /&gt;Now, several hours after the fact, the crowds are thinning. The people gathered in Ayala have been dispersed. Life has gone on. People have almost forgotten the events of today. The people feel numb, apathetic. The people&apos;s political skin has become leathered and calloused and weary as a result of too many parliaments in the streets (EDSA REVOLUTIONS) that have failed to achieve anything. &lt;br /&gt;I admit, I have to some extent shared this opinion in the past. However, now, I refuse to close my eyes or shield my eyes. &lt;br /&gt;&lt;br /&gt;A quote from Elie Wiesel: “The opposite of love is not hate, it&apos;s indifference. The opposite of art is not ugliness, it&apos;s indifference. The opposite of faith is not heresy, it&apos;s indifference. And the opposite of life is not death, it&apos;s indifference.” &lt;br /&gt;&lt;br /&gt;When we say that there is no hope, that nothing could be done, that we&apos;ll just have to accept thing the way things are, this is when the battle is lost. This is when hope is truly lost.  &lt;br /&gt;&lt;br /&gt;Life can never be perfect. There is no single country that has a perfect, ideal system of government or with perfect government officials. &lt;br /&gt;&lt;br /&gt;Reality will always be merely asymptotic to the ideal. &lt;br /&gt;&lt;br /&gt;The fact that EDSA II failed does not mean that it is time to give up. This just means, we&apos;ll have to try and try again until we learn how to make things better. &lt;br /&gt;&lt;br /&gt;Quoting Cheksa: &quot;But if we don&apos;t even &lt;b&gt;dare&lt;/b&gt;, then we might as well ask if the Filipino is worth dying for.&quot; &lt;br /&gt;&lt;br /&gt;To people who say, there is no other alternative but GMA, we can&apos;t remove her. What will happen to us? &lt;br /&gt;&lt;br /&gt;To this is reply, &lt;b&gt;&quot;Why not?&quot;&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;I just want an alternative to this government, where it seems that our most fundamental rights may be waived with a proclamation, where rights are safeguarded to protect us from government abridgement yet is blatantly violated by the head of the government.</description>

  <description>So fucking tired. had a horrid, horrid consti seatwork. i felt ma&apos;am gwen crawled into my head and turned everything into mush. &lt;br /&gt;&lt;br /&gt;Got caught in the rain a while ago, and as a result, i now have the mother of all headaches. grrrrr.&lt;br /&gt;&lt;br /&gt;QUICK, KILL ME NOW!&lt;br /&gt;&lt;br /&gt;FInals next, next week. Grrrr. Am going to try to study from morning to night in Rizal Library then continue on to Seattle&apos;s, for the next week. &lt;br /&gt;&lt;br /&gt;Does anyone want LAE forms? Danes?   <title>Last Night</title>

  <description>We had bar-ops yesterday! For those who don&apos;t know, the bar-ops is where the UP alumni taking the bar get to make slaves of their underclassmen. All the barristers (people taking the bar) were shacked up in a hotel and us underclassmen had to run odd errands for them like buy them drinks, food, medicine and anything else they desire.&lt;br /&gt;&lt;br /&gt;It was fun, if a bit exhausting because I had to walk back and forth to the mall to buy stuff. Afterwards, my blockmates and i squeezed into diane&apos;s car. (Hi Diane, if you&apos;re reading this! Comment ka naman, oh, para malaman ko na username mo. ^_^) On the way back to katipunan, we had some wonderful mindless chatter in the car, coupled with raunchy jokes and profanity despite the &apos;no lewd jokes and profanity in dianne&apos;s car rule&apos;.&lt;br /&gt;&lt;br /&gt;Glads, ches and i ate in shakey&apos;s upon getting back in katipunan. glads was feeling a tad depressed so we ordered some zombie from tia maria&apos;s and ate chicken and pizza at shakey&apos;s. What can i say? It was great! we talked for around 3 hours straight about life, love, sex, high standards, personal principles, sexual harrassment (a recent topic in our legal history class) and our own idiosyncratic ways. And the cigarettes and booze left me with the most wonderful buzz afterwards. Sigh.   <description>waaah. school is very draining and tiring. the cases seem endless. &lt;br /&gt;&lt;br /&gt;i&apos;ve been questioning whether or not i really want to be in law school. whether or not i really want to live this kind of crazy lifestyle. &lt;br /&gt;&lt;br /&gt;But you know what, THERE&apos;S NOTHING ELSE I WOULD RATHER DO. Yes, it may be difficult. but all things worth getting are difficult. &lt;br /&gt;&lt;br /&gt;and for me, this is worth it. And there&apos;s no school I&apos;d rather go to than UP. With my wondeful classmates. With my brilliant teachers--who make believe that there are good lawyers in this world, and that you can grow up without losing the strenght of one&apos;s convicitons. &lt;br /&gt;&lt;br /&gt;Hahaha, midterms here i come. ^_^</description>

My block had won first place in the volleyball game, first in the palarong pinoy, second place in billiards, third place in the basketball game and fourth in the vice relay (we&apos;re such good girld and boys, we&apos;re not much for drinking and smoking, hehehe).&lt;br /&gt;&lt;br /&gt;We weren&apos;t really sure if we could win the whole thing. We had tried to practice more for several weeks but most of them were didn&apos;t push through, so we had a lot of practices where we weren&apos;t just doing anything 60% of the time. However, we were able to pull it off. It was, by all accounts, a pretty good presentation. We had a good concept in the first place (thanks to lenipaps) and a good enough sound editing team (Ten and myself) to carry out the concept. The actual presentation was great. Imagine, our block bagged the 2 major awards of the night, namely Best Musical and Best Block. Add to that, our beautiful (sobrang totoo &apos;to dahil madaming girls ang  natibo sa kanila, myself included!) Miss Freshman candidates won two very important awards: Miss Talent (the dashing Oliver &apos;Olivia&apos; Yee with the killer body and all) and MIss Freshman (the alluring Bruno &apos;Brunella&apos; Tangangco, because of whom nursery rhymes will never be the same again).. Goddammit, i&apos;ve looked 16 years old for the last 4 years. I looked 16 when i was actually sixteen, but it seems i haven&apos;t aged at all since then. Even my roommates refuse to believe i&apos;m in law school because i look like i&apos;m a freshman in college. gggrrrrr....</description>

  <title>Weekend</title>

  <description>The weekend was a blast. &lt;br /&gt;&lt;br /&gt;SATURDAY:&lt;br /&gt;&lt;br /&gt;-Didn&apos;t get called for recits in Crim&lt;br /&gt;&lt;br /&gt;-Plucked Bruno&apos;s eyebrows for the Miss Freshman Beauty Contest that we have for freshman week. He&apos;s dressing up as a slutty dominatrix bitch-goddess from Sin City. &lt;br /&gt;&lt;br /&gt;-Went with timi to rockwell to see gaiman. OhmyGOD. he is so much fucking HOTTER in person than i ever imagined. &lt;br /&gt;&lt;br /&gt;-Met up with some college friends who are studying in ateneo rockwell. &lt;br /&gt;&lt;br /&gt;-Met up with danes in the Gaiman signing. *waves* I have your picture....mwahahaha. Well, martin has your picture. &lt;br /&gt;&lt;br /&gt;-Went to greenhills with Tim to hang in our favorite coffee shop there. i was so tired from the Gaiman thing and from too many sleepless nights, so i dozed on Timi&apos;s shoulder while he read a magazine. After an hour or so, he treated me coffee to get me awake (aww, sweetness). We looked at the newly opened fully booked in greenhills (which has very little on stock). Tim also was wonderful enough to bring me to several book stores and I salivated over things we can&apos;t afford. &lt;br /&gt;&lt;br /&gt;-Went to my law school block party. WHoo. Section D rocks. I got to introduce timi to my block, although he had to leave early to run some errands. I ended up going home at four in the morning. Did things i haven&apos;t done in years, like smoking and using beer as a chaser for tequilla. My blockmates and i are such philosophical drunks(as opposed to happy drunks and angry drunks). We talked about male-female dynamics, sex, Filipino sexuality, the current political situation, youthful idealism and the obligations of maturity, and love. It was a weird cross between a raymond carver story and a formal debate, mixed in with pathetic little law school jokes. &lt;br /&gt;&lt;br /&gt;-I ended up drinkig too much tequilla because of this i-have-never-done-something drinking game we had. A person makes a statement like &apos;i have never performed a blow&apos; and if this doesn&apos;t hold true for you, you have to drink a shot. Too many of my blockmates have never been on a date, or been in a relationship for more than one year, so i ended up being one of people who had to drink the most. Hehehe, i&apos;d curse my life experiences if it wasn&apos;t so fun. &lt;br /&gt;&lt;br /&gt;SUNDAY:&lt;br /&gt;&lt;br /&gt;-Nursed a hang-over, had lunch with the folks, spent the day with tim and his family and read a GREAT book. Pretty damn good all things considering.</description>

Now i&apos;ve been sick twice since the start of the school year. grrrr. &lt;br /&gt;&lt;br /&gt;thank god I have my blockmates with me. I have such lovely, lovely people in my block.&lt;br /&gt;&lt;br /&gt;Others:&lt;br /&gt;-I moved into my new dorm yesterday, i&apos;m actually living in katiupnan again. it&apos;s weird living here again after graduating from college.&lt;br /&gt;&lt;br /&gt;-The dorm provides high speed internet. whoo-hoo!&lt;br /&gt;&lt;br /&gt;-No classes today because ma&apos;am beth is busy. whoo-hoo! no grilling in persons today! &lt;br /&gt;&lt;br /&gt;-Waves to danes! i miss you, dear! ^_^ well, companies like &apos;em young. they&apos;re more malleable that way. read your post. &apos;atta girl, what fun would life be if you compromised on what you want to do? let&apos;s get together one saturday or something.</description>

  <description>I got sick last friday.&lt;br /&gt;&lt;br /&gt;My family was worried, and my fever gave me an excuse to just rest and be pampered and taken care of. My folks ordered chinese food for me, etc. It was great.  &lt;br /&gt;&lt;br /&gt;Much to my dismay, I was feeling better by saturday morning, and all traces of fever was gone. Grrr. it&apos;s always been like this for me, whenever i&apos;d get sick, it would only last one day or two at most. Case in point, i once met up with martin in megamall when i was sick. at  lunch, i was shivering and was so weak that i couldn&apos;t feed myself so martin had to help me eat. Five hours after this, i was walking around greenhills, shopping, chills and fever-free.&lt;br /&gt;&lt;br /&gt;Grrr. I hate my immune system, i can never milk my sicknesses for all it&apos;s worth.</description>
